SERVICE AND LIMITED WARRANTY

Effective Jan. 25, 2024 and replaces all previous agreements.
Simply Bread Co. Europe TWO-YEAR LIMITED WARRANTY

Simply Bread Co. Europe warrants the Simply Bread Oven for a period of 2 years from the date of delivery. This warranty gives you specific legal rights, and you may also have other rights which may vary among countries in Europe, Middle-East, Africa and Asia (EMEA). The warranty coverage is for the intended use of baking bread and associated baking, and following the User Manual provided by Simply Bread. Warranty coverage and replacement parts shall be as follows:

PARTS:

  • Printed Circuit Boards and associated assemblies

  • Heating elements

  • Temperature sensors

  • Steam generator components

  • Steam release components

  • Cooling fans

  • Door hardware

WARRANTY PERIOD:

Two Years from Delivery Date.


COVERAGE:

Shipping Damage

If the shipment is managed by Simply Bread Co. Europe and is damaged, Simply Bread Co. Europe will repair or replace the shipment and/or damaged items. If there is any indication of shipment damage and/or the tipping indicator has been triggered, in order for Simply Bread Co. to repair and/or replace the shipment, the customer is required to refuse to sign for the shipment, or accept the shipment and add comments describing the damage on the carrier's copy of the shipping documents. In the event of shipping damage, the customer must notify Simply Bread Co. within 7 calendar days by contacting the Support team at ops-europe@simply-bread.co. Failure to take these actions may impact Simply Bread Co. Europe’s ability to repair or replace the shipment and/or damaged items.

Material and Manufacturing Defects

Simply Bread Co. Europe’s entire liability and the exclusive remedy shall be replacement or repair of the defective parts of your Simply Bread oven, if required. Any part(s) approved for return by Simply Bread Co. Europe’s Customer Service must be returned to the designated Simply Bread Co. Europe office as noted under Additional Information below. The shipment will be prepaid by Simply Bread Co. Europe. Simply Bread Co. Europe may replace defective parts with new or refurbished parts, at Simply Bread Co. Europe’s sole discretion. Without limiting the exclusions stated above, there is no warranty coverage beyond manufacturing defects and normal wear and tear.

Simply Bread Co. Europe ovens are designed to be repaired by an accredited technician recognized by Simply Bread Co. Europe. Simply Bread Co. Europe’s entire obligation under this warranty shall be to provide you with replacement of any defective parts and
i) provide you with instructions on how to make the replacement,
ii) if required, supply a certified technician to replace or repair the defective part on-site,
iii) if required as a last remedy, provide shipment to Simply Bread Co. Europe factory for repair and/or replacement.
Simply Bread Co. Europe may replace defective parts with new or refurbished parts, up to and including replacement of the oven at Simply Bread Co. Europe’s discretion. Simply Bread Co. Europe reserves the right to inspect any Oven (shipping paid by Simply Bread Co. Europe) and to analyze any usage information, including, without limitation, any digitally connected oven data. To validate and process a warranty claim, Simply Bread Co. Europe may require that you provide reasonable evidence of your issue, including participating in video chats, phone conversations, providing photos, and providing other relevant information.


FOR GREATER CERTAINTY AND TO THE FULLEST EXTENT PERMITTED BY LAW, SIMPLY BREAD CO. EUROPE SHALL NOT BE LIABLE UNDER THIS OR ANY IMPLIED WARRANTY FOR INCIDENTAL, CONSEQUENTIAL DAMAGES, INDIRECT, SPECIAL, LOSS OF DATA, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE ARISING OUT OF OR RELATING TO YOUR USE OF YOUR OVEN, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT SIMPLY BREAD CO. EUROPE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT, OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE. THIS WARRANTY GIVES THE RETAIL CUSTOMER SPECIFIC LEGAL RIGHTS AND THE CUSTOMER MAY HAVE OTHER RIGHTS WHICH VARY AMONG COUNTRIES. BOTH YOU AND SIMPLY BREAD CO.  EUROPE INTEND FOR THIS WARRANTY TO BE YOUR EXCLUSIVE REMEDY FOR A DEFECTIVE OVEN.


This warranty shall be void if:
(i) the Oven is not assembled or operated in accordance with Simply Bread Co. Europe’s operating instructions provided with this Oven;
(ii) there has been use of any incompatible third-party components;
(iii) the user has allowed the Oven to become damaged, abused, or otherwise failed to maintain the Oven in accordance with Simply Bread Co. Europe’s operating and maintenance instructions; or
(iv) there has been any unapproved modification of this Oven.

ADDITIONAL IMPORTANT INFORMATION

Simply Bread Co. Europe will determine if your warranty claim is covered under this warranty policy at Simply Bread Co. Europe’s sole and complete discretion, and failure to follow the required procedures may void your warranty claim.
