IMPORTANT NOTICE:
This document contains important information regarding your rights and obligations. Please read it carefully before placing an order. By placing an order through our website, you agree to be bound by these Terms and Conditions.


1. Scope

These Terms and Conditions ("Terms") apply to the purchase and sale of products and services through eu.simply-bread.co (the "Site"), operated by Simply Bread Co. Europe SRL, a Belgian company registered at Avenue Pré Aily 24, 4031 Angleur, Belgium under the VAT number BE1004654239. These Terms may be updated from time to time. The most recent version is always available on the Site.

By placing an order on the Site, you agree to these Terms. If you do not agree, you should not place an order.

You must be at least 18 years old or the legal age in your country to form a binding contract to place an order.


2. Order Acceptance and Cancellation

(a) Your order is an offer to purchase under these Terms. All orders must be accepted by us to be binding. We may decline any order at our sole discretion.

(b) Once you place an order, you will receive an order confirmation email. This does not mean the order is accepted. Acceptance takes place upon dispatch of the product and confirmation of shipment.

(c) We reserve the right to cancel or reject any order, including for errors in pricing or availability.


3. Prices and Payment Terms

(a) All prices on the Site are shown in euros (EUR). While local currencies may be displayed for convenience, all charges are made in euros. Prices exclude applicable VAT, duties, and shipping unless otherwise stated. Taxes and shipping fees are calculated and shown during checkout and in your confirmation email.

(b) Payment is due in full at the time of order unless otherwise agreed in writing. We accept major payment methods available via our payment platform, including credit card, PayPal, and other methods as indicated on the Site.

(c) You confirm that the payment information you provide is accurate and that you are authorized to use the payment method.


4. Shipments; Delivery; Title and Risk of Loss

(a) We ship products to the address provided during checkout. Shipping is included in most regions, but surcharges may apply for remote or difficult-to-access areas. Customers are responsible for such surcharges.

(b) Delivery times are estimates and not guaranteed. Title and risk of loss pass to you upon delivery to the destination address.

(c) All deliveries are made under Incoterms 2020 DAP (Delivered at Place), unless otherwise specified in writing by Simply Bread. This means we bear the cost and responsibility for delivery up to the agreed destination, but any applicable import duties, taxes, or customs clearance costs are borne by the buyer.

(d) We are not liable for delays caused by the carrier or customs clearance.


5. Returns and Refunds

(a) Products may be returned within 15 calendar days of delivery, subject to a 20% restocking fee and provided they are unused and returned in original packaging and condition.

(b) The customer is responsible for preparing the item for return and covering all return shipping costs. Risk of loss remains with the customer until received.

(c) Refunds are processed to the original payment method used for the order, less any applicable restocking, shipping or processing fees.

(d) Orders cancelled before shipment may be refunded in full, minus any payment processing fees (e.g., credit card or platform fees).

(e) If you notice any visible damage or defect on the packaging at the time of delivery, you must refuse the delivery and immediately notify us by email with supporting photos. Accepting a damaged parcel without reservation may void your right to a return or refund.


6. Warranty

Products purchased from the Site are covered by a two-year limited warranty, as described in the Warranty & Service Policy published on the Site.

This warranty does not apply to damage caused by misuse, modifications, or improper installation.

In the event of an issue with your oven, please contact our customer support by email or phone to initiate remote diagnostics. When possible, we may ask you to connect your oven to Wi-Fi so that we can access operating data to better understand the problem.


7. Use Restrictions

Products are sold for end-user use only. They may not be resold or exported without prior written permission.


8. Intellectual Property

Simply Bread Co. Europe SRL remains the exclusive owner of all intellectual property rights associated with its products, website content, documentation, and related materials. Nothing in these Terms grants any license or ownership rights to you.


9. Data Protection

We process personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). Our Privacy Policy, available on the Site, explains how we collect and use your data.


10. Governing Law and Jurisdiction

These Terms are governed by the laws of Belgium. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Namur, Belgium.


11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, along with our Privacy Policy and any other written agreements or confirmations, represent the entire agreement between you and Simply Bread Co. Europe SRL regarding your purchase.
